These terms and conditions are effective from July 1, 2026, and apply to all purchases and agreements made on www.mobymountain.com.
The terms are divided into two main sections:
PART 1: Terms and Conditions for Private Customers (B2C) – Applies to consumers.
PART 2: Terms and Conditions for Business Customers and Resellers (B2B) – Applies to anyone with a B2B login or purchasing as a business.

PART 1: Terms and Conditions for Private Customers (B2C)

These terms apply to consumer purchases of goods on . The terms are drawn up in accordance with applicable EU consumer legislation, including the Danish Sale of Goods Act and the Danish Consumer Contracts Act.
 

1. Prices and Payment

Prices on the website are displayed in the currency relevant to your country and include the local VAT applicable to your country. Moby Mountain ApS is registered under the EU’s One Stop Shop (OSS) VAT scheme, which means that the correct local VAT rate is automatically calculated and charged at checkout depending on which EU country you are located in. The total price you approve at checkout is the full amount including VAT and any shipping costs.
We accept the following payment methods:
  • All countries: Visa, Mastercard, bank transfer.
  • Denmark: Dankort, Visa/Dankort, MobilePay Online, Anyday (buy now, pay later).
  • Other EU countries: PayPal (incl. PayPal’s “Buy now, pay later” solution).
We are continuously working on expanding our payment options. Current payment methods are always shown at checkout. Please note that payment with a corporate credit  card may incur an additional surcharge depending on the card type. The applicable
surcharge is shown at checkout.
Moby Mountain ApS uses a secure payment server that encrypts all information with SSL protocol.
When is the money deducted?
  • Stock items: The amount is first deducted from your account when the physical item is dispatched from our warehouse.
  • Made-to-order items: If your order contains items that are produced or imported specifically for you (e.g., roof tents), the full order amount is deducted upon ordering, as production is initiated immediately thereafter.
 

2. Delivery

We deliver to all countries within the EU and EEA. We also deliver to Norway and Switzerland. In Denmark, we only deliver to bridge-connected islands.

Delivery to Norway and Switzerland:

We deliver to private customers in Norway and Switzerland on DDP terms (Delivered Duty Paid), which means that we generally cover customs and local import duties, and you will not be charged any extra amounts upon delivery. The price you approve at checkout is the price you pay.

Since Norway and Switzerland are not EU members, deliveries to these countries require customs clearance. In this connection, we may need additional information from you, e.g., a national identification number for customs declaration purposes. If we need such information, we will contact you directly after ordering. Failure to reply may delay delivery.

Delivery times:

On most products, an expected delivery week is shown directly on the product page. If the item is currently in stock, the current week is shown. Please note that orders placed mid or
late in the week are typically delivered the following week, to allow for processing and delivery time. Orders placed over the weekend are processed the first coming weekday. For items without a week delivery display, the delivery time is 5-10 weekdays.

Made-to-order items: 1-120 days, depending on what is stated for the specific item when ordering.
Delivery methods:
  • Pick-up at our address (only for purchases incl. mounting service).
  • Parcel post (e.g., GLS) to private address or parcel shop.
  • Freight carrier (for larger shipments such as roof tents).
Shipping costs include a packaging fee, all packaging materials, and any specially produced pallet, and are calculated based on the weight of the shipment. The total shipping price is clearly stated before you approve the purchase.
 

Special for delivery with freight carrier (roof tents):
You must be at home at your address to receive the package during daytime hours on the agreed delivery day. The freight carrier typically calls 30 minutes before arrival. If you are not at home on the agreed day, any extra shipping costs for redelivery will be charged to you.

Important: Check the item upon receipt
We encourage you to inspect all goods for transport damage immediately upon receipt, before signing for the delivery. Roof tents are large shipments that can be damaged during transport. If there is visible damage to the packaging, please note this on the waybill and immediately contact us at welcome@mobymountain.com with pictures. The sooner a transport damage is reported, the better chance we have to help you. Your rights under the Sale of Goods Act are not affected by this, but a quick report is in your best interest.

 

3. Right of Withdrawal

As a consumer, you have a 14-day right of withdrawal when shopping with us.

Calculation of the deadline:
The withdrawal period expires 14 days after the day you received your item. If you have ordered several different items in one order, but they are delivered individually, the period runs from the day you receive the last item.

Special for made-to-order items:
When purchasing goods that are manufactured or customized specifically for you (made-toorder items), you waive your right of withdrawal upon accepting the purchase, as production begins immediately after ordering. This will be clearly stated when purchasing the item in question.

How to exercise your right of withdrawal:
You can use the digital withdrawal function, which you will find via the link “FORTRYDELSESRET” (Right of Withdrawal) at the bottom of our website. The function is set up in accordance with EU requirements and guides you through the process. Once you have submitted your withdrawal, you will immediately receive a receipt by e-mail. You cannot withdraw from the purchase simply by refusing receipt of the item without simultaneously giving us clear notice thereof.

Return and costs:
Once you have notified us that you wish to withdraw your purchase, you have 14 days to send the item back to us. You must pay for the return of the package yourself, and you are liable if damage occurs during transport. Make sure the item is securely packaged. Larger items such as roof tents must be packed and strapped to a pallet.

The condition of the item upon return:
You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods. For a roof tent, this means that you may examine and test the tent on the ground, but you may not mount it on your car or put it into actual use, as the item will then be considered used. If the item has been tested beyond what is described above, we consider it used, and upon withdrawal, you will only get part or none of the purchase amount back. It is up to Moby Mountain ApS to assess the condition of the item.

Refund:
If you withdraw your purchase, we will refund all payments received from you for the item itself, no later than 14 days from the day we receive your withdrawal notice. We may withhold the payment until we have received the item back, unless you send us documentation of having returned it. Please note that return shipping is at your expense, and the original delivery costs are not refunded, as these were incurred in connection with the delivery to you.

 

4. Right of Complaint (Warranty)

When you shop with us as a consumer, you have a 24-month right of complaint in accordance with the Sale of Goods Act. This means that you can make a claim against us if the item has faults or defects for which we are responsible, and which appear within 2 years from delivery.

Depending on the situation, you may have the right to: repair, replacement, a proportionate reduction in price, or cancellation of the purchase (refund) if the defect is significant and cannot be remedied.

Our preferred solution for justified complaints is to send spare parts and a video guide for replacement, as almost all parts on our roof tents can be replaced relatively easily. This saves you the trouble of returning a large and heavy product and ensures a quick solution.

You must complain within a “reasonable time” after you have discovered the defect. A complaint made within 2 months after discovery is always timely.

We do not accept packages sent cash on delivery (COD) or packages sent without delivery to the door.

Recipients and disclosure:
We disclose your information to freight partners (e.g., GLS, freight carriers) and payment providers (e.g., PensoPay, PayPal) to the extent necessary to fulfill your order. We never sell your personal data to third parties for marketing purposes. We use third-party tools such as Google Analytics and Facebook Pixel for statistics and marketing. These services may transfer data to servers in the USA. The transfer is based on the EU Commission’s Standard Contractual Clauses (SCC) or the EU-US Data Privacy Framework. You can withdraw your consent to such cookies at any time via our cookie banner.

Retention period:
Customer information in connection with purchases is kept for 5 years in accordance with the Danish Bookkeeping Act, after which it is deleted. Newsletter data is kept until you unsubscribe.

Your rights: 

You have the following rights under GDPR:

  • Right of access: Right to see what information we have registered about you.
  • Right to rectification: Right to have incorrect information corrected.
  • Right to erasure: Right to have your information deleted, unless we are obliged to keep it (e.g., due to the Bookkeeping Act).
  • Right to restriction: Right to limit the processing of your information in certain situations.
  • Right to data portability: Right to receive your information in a structured, machinereadable format.
  • Right to object: Right to object to processing based on legitimate interest or for marketing.
  • Withdrawal of consent: If the processing is based on your consent, you can withdraw it at any time without affecting the lawfulness of prior processing.
Inquiries regarding your rights should be directed to welcome@mobymountain.com. You also have the right to lodge a complaint with the national data protection authority in your country. 6. Complaints Procedure

If you want to complain about your purchase, please contact us at welcome@mobymountain.com. If we do not succeed in finding a solution, you can, as a consumer in Denmark, file a complaint with Nævnenes Hus, Toldboden 2, 8800 Viborg via www.naevneneshus.dk. If you are a consumer residing in another EU country, you can complain via the EU Commission’s online dispute resolution platform: http://ec.europa.eu/odr. PART 2: Terms and Conditions for Business Customers and Resellers (B2B )

These terms apply to all purchases made by businesses, as well as to the ongoing collaborative relationship for companies that have created a reseller login (B2B platform) with Moby Mountain ApS.

By creating a B2B account or making a B2B purchase on our platform, you fully accept these terms and conditions. These terms supplement, but do not replace, any separate written agreements that may have been concluded directly with Moby Mountain ApS. In the event of a conflict between these terms and a separate written agreement, the separate agreement shall prevail.
 

1. Reseller Status and Collaboration

Upon creation and approval as a reseller, Moby Mountain ApS appoints the reseller as a nonexclusive, authorized reseller.

  • The reseller acts in its own name and for its own account as an independent business and is not appointed as a distributor, agent, or representative of Moby Mountain.
  • Reseller status and associated benefits (e.g., discount rates) are determined by Moby Mountain and may be changed continuously.
  • The reseller may not transfer its rights as a reseller without prior written approval from Moby Mountain.
 

2. Ordering, Prices, and Payment

All B2B orders must be placed via Moby Mountain’s B2B platform. Product prices are shown on the website including VAT. For resellers with a valid EU VAT registration number, VAT is automatically deducted in the checkout flow, and the order is invoiced VAT-free. Moby Mountain verifies the VAT number upon creation. The reseller is responsible for correct VAT reporting in its home country.
  • Moby Mountain reserves the right to adjust prices with prior notice.
  • Payment methods: Resellers can pay via bank transfer or credit card. Payment with a corporate card is subject to an additional surcharge depending on the card type. The applicable surcharge is shown at checkout.
  • Payment terms: All orders are prepaid, unless otherwise agreed in writing.
 

Note on discount calculation:
The reseller discount is calculated based on the recommended retail price minus the local VAT rate in the reseller’s home country — not the Danish VAT rate. Contact us at welcome@mobymountain.com if you are unsure about the calculation for your country.

 

3. Delivery and Freight Options (B2B)

Moby Mountain offers two delivery setups for resellers:
  1. Consolidated delivery to the reseller’s address (recommended for stocking)
    Recommended for resellers who wish to keep goods in their own stock. Provides the lowest freight costs per tent and the possibility of direct mounting on the customer’s car from own stock.

  2. Drop Shipping (direct to end customer)
    A service we offer for handling smaller orders. Moby Mountain arranges all warehousing, order handling, freight booking, and delivery directly to the reseller’s end customer. Dropshipping is only available within the EU. Orders of 1-3 tents are handled via the drop shipping solution and are charged the corresponding drop shipping freight prices, which are higher than pallet prices, as they include full order handling and direct delivery. All freight prices include a packaging fee, all packaging materials, and a specially produced pallet. Freight prices are calculated based on the weight of the shipment and are shown at the end of the order. Pick-up at our warehouse in Denmark is possible against payment of a pick-up fee per pallet, which covers packaging and materials. The fee is shown at checkout. Important: Check goods upon receipt
The reseller is responsible for inspecting all goods for transport damage immediately upon receipt, before signing for the delivery. Visible transport damage must be noted on the waybill and reported in writing to Moby Mountain within 5 weekdays of delivery. Hidden damage discovered during unpacking must be reported within 7 days of delivery. If these deadlines are exceeded, Moby Mountain cannot make a claim against the freight company, and the liability passes to the reseller. Reports should be made to welcome@mobymountain.com with pictures and a description of the damage.

 

4. Customer Service and Warranty (End Customers)

The reseller is fully responsible for all communication and service towards its own end customers, including product inquiries, order issues, and warranty claims.
  • Warranty: Moby Mountain provides a 2-year warranty from the date of delivery to the end customer.
  • Handling of claims: Complaints must be submitted to Moby Mountain via the complaint form on the B2B platform with relevant documentation (pictures, video, production numbers). Moby Mountain will generally send spare parts and a video guide for replacement, as almost all parts can be replaced relatively easily. In rare cases, a replacement item may be offered.
  • The reseller is not entitled to offer end customers full refunds, exchanges, or compensation at Moby Mountain’s expense without prior written consent.
 
 

5. Marketing and Brand Use

Moby Mountain grants the reseller the right to use logos, pictures, videos, and product texts for marketing the products as long as the reseller status is active.
  • The reseller must always clearly appear as an independent reseller and may not pretend to be Moby Mountain.
  • The reseller may not copy Moby Mountain’s website design, SEO texts, or product layouts directly. We strongly recommend rewriting product texts.
  • Upon termination of the reseller collaboration, the reseller must immediately remove all Moby Mountain material from its platforms.
 
 

6. Intellectual Property Rights (IP)

All intellectual property rights to the products, the brand, and the materials belong exclusively to Moby Mountain ApS. It is strictly forbidden to copy, reverse-engineer, or replicate any Moby Mountain products, either in whole or in part. This restriction applies for 10 years after the termination of the collaboration, regardless of the reason for termination. Any breach is considered a material breach of contract and will result in legal action.
 
 

7. Confidentiality

The reseller undertakes to treat all business-related information, prices, internal documents, and communication from Moby Mountain as strictly confidential. This information may not be shared with third parties, and in particular not with competitors, without written consent. The confidentiality obligation applies indefinitely, also after the termination of the collaboration.
 
 

8. Duration and Termination

The collaboration and access to the B2B platform run until terminated by either party with 30 days’ written notice. Moby Mountain may close a reseller account immediately in the event of a breach of contract, misuse of brand or IP, harmful behavior, or a strategic decision to discontinue the collaboration.
 
 

9. Limitation of Liability and Force Majeure (B2B)

Moby Mountain’s liability towards business customers and resellers is limited to the invoice value of the product(s) to which the claim relates. Moby Mountain is not liable for operating loss, loss of profit, or other indirect loss. Neither party is liable for non-performance due to force majeure.
 
 

10. Governing Law and Jurisdiction

These terms are governed by Danish law. Any dispute shall be settled by the District Court in Kolding, Denmark.
